This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name [www.aukurban.com] (“Website”), including the related mobile site and mobile application (hereinafter referred to as “Platform”).
The Platform is owned by AUK URBAN, a proprietorship firm having its registered office at A-61/3 East Azad Nagar, Delhi - 110051 (hereinafter referred to as the “Platform Owner”, “we”, “us”, or “our”).
Your use of the Platform and services are governed by the following Terms & Conditions (“Terms of Use”) applicable to the Platform. By accessing or using the Platform, you agree to comply with and be legally bound by these Terms.
ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE.
1. USER INFORMATION
You agree to provide accurate, current, and complete information during and after registration and shall be responsible for all activities carried out through your account.
2. PRODUCTS & SERVICES
AUK URBAN provides apparel manufacturing, wholesale clothing, custom printing services including but not limited to DTF, DTG, Screen Printing, Puff Printing, Vinyl Printing, Velvet Printing, Spangle Printing, and related apparel services.
3. CUSTOM ORDERS
Custom printed and customized products are manufactured according to customer requirements. Therefore:
- Custom printed items are non-returnable and non-refundable.
- Minor variation in print placement, color shade, fabric texture, and sizing may occur due to production processes.
- Digital mockup colors may slightly differ from actual printed output.
4. ORDER CANCELLATION
- Orders may be cancelled only before production starts.
- Once production has started, cancellation requests will not be accepted.
- Advance payments made for customized or bulk orders may be non-refundable depending on production stage.
5. RETURN & EXCHANGE POLICY
- Returns and exchanges are accepted only for manufacturing defects or wrong product delivery.
- Claims must be raised within 48 hours of delivery with proper unboxing proof/photos.
- Slight color, print, or size variations shall not be treated as defects.
- Customized products are not eligible for return or exchange.
6. PAYMENT TERMS
- We accept prepaid as well as Cash on Delivery (COD) orders where applicable.
- Bulk and custom manufacturing orders may require advance payment before production.
- GST will be charged extra as applicable under Indian law.
7. SHIPPING & DELIVERY
- Delivery timelines are estimates and may vary depending on location, order quantity, courier operations, festivals, weather conditions, or unforeseen circumstances.
- AUK URBAN shall not be held liable for delays caused by third-party logistics providers.
8. INTELLECTUAL PROPERTY
All content on the Platform including logos, graphics, product designs, images, text, and branding are the intellectual property of AUK URBAN.
Customers submitting logos, artwork, or designs confirm that they hold the legal rights to use such content. AUK URBAN shall not be liable for copyright or trademark infringement arising from customer-provided content.
9. UNAUTHORIZED USE
Unauthorized use of the Platform or its content may result in legal action under applicable laws.
10. THIRD-PARTY LINKS
The Platform may contain links to third-party websites for convenience. We do not control or endorse such websites and are not responsible for their content or policies.
11. LIMITATION OF LIABILITY
AUK URBAN shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of the Platform or Services.
The total liability of AUK URBAN, if any, shall not exceed the amount paid by the customer for the relevant order or Rs.100, whichever is lower.
12. FORCE MAJEURE
We shall not be liable for failure or delay in performance caused by events beyond reasonable control including natural disasters, strikes, government restrictions, transport disruptions, or technical failures.
13. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and interpreted in accordance with the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
